What is the duration of the Redemption Period?

Six (6) calendar months after announcement of Winner by Decode (hereinafter defined as “Redemption Period”).

By participating in this Offer, user (“You”, “Your”, “Customer” or “Participant”) agree to be bound by the following:

the Offer terms and conditions below (“T&C”);

the Terms of Use, Privacy Policy, Terms and Conditions for Gift Cards and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Platform including any modifications, alterations or updates that Decode and/or the participating seller/s makes. ; and

The Offer shall take place on the Decode’s app, from 00:00 hrs on 20th March 2023 and end at 23:59 hrs on 21st March 2023 (“Offer Period”).

To participate in the Offer You must to do/ fulfill the following:

You acknowledge and confirm that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorised persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Decode or the Seller shall not be responsible in any manner.

In the event any Winner cancels the order for the Products placed during the Offer, he/she shall not be eligible for the Prize.

III. OTHER TERMS AND CONDITIONS

Decode Return & Exchange Policy Offers gives you the option to return or exchange items purchased on Decode mobile app within thirty (30) days of the receipt. In case of return of the purchased item, please refer to the “Return Policy” on Decode or write to returns@Decode.com.

The expected delivery duration will be mentioned at the time of booking.

If Decode has suspicion or knowledge that any Customer is or has been involved in any fraudulent or illegal activity directly or indirectly during or after the “Offer”, Decode reserves the right to disqualify such Customer and any related Customers. Decode and/or Seller shall not be responsible if some purchase is not registered or is lost due to any network issues/problems such as breakdown of machinery, unclear/ disruption in the network or non-receipt of payment from banks/payment gateways and/or the cost(s) charged by the network operator(s). Any dispute in connection to the same shall be settled between the end customer and the network operator without involving Decode and/or Seller.

The Offer shall be subject to force majeure events rendering Decode and/or the Seller unable to extend the Offer, for reasons beyond Decode’s or the Seller’s control, such as, but not limited to Acts of God, acts of civil or military authorities, acts of public enemy, terrorist attacks, war, threat of war, destruction of network, strikes, lock-out, riots, civil disturbances, political disturbances, insurrections, accidents, explosions, fire, earthquake, flood, epidemics, acts of government, agencies or officers, volcano, volcanic ash, natural calamities, or any other legitimate cause restraining performance and on occurrence of such an event, the Offer may be completely or partially withdrawn at the discretion of Seller and/ or Decode and Seller or Decode shall not be liable to pay any monetary compensation or otherwise for the same.

Decode and/or Seller does not hereby warrant that the Decode Call Center will run concurrently and error free during and/or after the “Offer” and Decode shall not be directly liable for issues related to technical and/or human error whatsoever. However, Decode shall work towards the best interest of the Customer.

The Eligible Products cannot be resold at any point in time.

Customers hereby agree that Decode and/or Seller has the sole right to decide all matters and disputes arising from this Offer and that all decisions of Decode and/or Seller are final and binding.

This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.

No other offers will be in conjunction with this Offer.

This Offer cannot be clubbed with any other promotion/discount of the Seller.

Decode shall contact the winners via email or call to announce the results.

Decode and/or Seller reserves the right to amend, modify, cancel, update or withdraw this Offer at any time without notice. Neither Decode nor Seller shall be responsible for any indirect or consequential loss or damage, injury or any other liability arising due to participation by any person in this Offer.

Decode does not endorse the products sold on the Platform and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products, which shall be at the sole liability and responsibility of the sellers.

In case of any dispute or difference arising concerning the Offer or any alleged defect in the Eligible Products or deficiency of service availed, the same shall be resolved by Seller and Decode shall not be a party to the same.

You hereby agree to indemnify and keep Decode and Seller harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney’s fee) that may be suffered by Decode and Seller because of (i) violation of terms of this T&C by You; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on Your part.

Any query regarding this Offer will be entertained only till 20th May 2022 Post such date Decode and/or Seller will not entertain any correspondence or communication regarding this Offer from any persons.

CUSTOMER INFORMATION AND VISIT TO MOBILE APP

By placing an order for the Contest, you warrant that:

You are legally capable of entering into binding contracts;

20. Flipkart shall not be liable for any failure by Brand to provide Offer benefits/ Prizes to the Winner. Brand shall indemnify and hold Decode harmless against any claims by the Winners in this regard.

You hereby authorize Us to hold, receive and disburse funds in Your Decode Credit in accordance with any payment instructions We receive from You.

All Transactions shall be subject to the following:

c.tTransfer of funds from Your Decode Credit to another users Decode Credit shall not be permitted.

Your Decode Credit shall be valid and operational for a period of 1 (one) year from the date of activation/issuance to You, until suspended/ terminated by Decode in accordance with these User Terms, unless the validity of the Decode Credit is extended by Us at Our discretion.

The maximum permissible period of non-use of the Decode Credit (Permissible Dormant Period) shall be 1 (one) year either from the date of issuance or from the date of the last use of the Decode Credit, whichever is later. You agree that any outstanding balance in Your Decode Credit shall be forfeited at the time of expiry of the Decode Credit or at the time of suspension/termination of Your Decode Credit for any reason whatsoever. Information about the forfeiture of Your Decode Credit balance (due to the impending expiry of Your Decode Credit) shall be intimated to You at reasonable intervals, during the 45 (forty five) days period prior to the expiry of Your Decode Credit.
